1 - IPR - LMICsTournament: Bronx | Round: 1 | Opponent: Hawken KJ | Judge: Doggett, Matthew The value is morality, because the use of the word “ought” in the resolution implies moral obligation. The value criterion is Distributive Justice. Prefer for two reasons: 1 The Difference Principle- prioritizing providing for the disadvantaged. 2 Allocation of equal material goods to all members of society. The definition of ought proves to us the clear question in this resolution. It is morally correct of us to equally distribute our goods and resources. But the use of patents entirely restricts us from fulfilling our moral duties. Framework Sekalala, S., Forman, L., Hodgson, T., Mulumba, M., Namyalo-Ganafa, H., and Meier, B. M. (2021). Decolonising human rights: how intellectual property laws result in unequal access to the COVID-19 vaccine. BMJ global health, 6(7), e006169. https://doi.org/10.1136/bmjgh-2021-006169 LMICs are being prohibited access to buy or make vaccines due to the desperate need of a patent waiver. Therefore, this current issue directly relates to the resolution in question. The immediate crisis of COVID-19 has triggered countries to beg for TRIPS waivers in order to get vaccines. | 10/15/21 |
JF - Consequentialism, Debris, I-LawTournament: Regionals | Round: 1 | Opponent: Stranahan MD | Judge: Agarwal My standard is maximizing expected well-being. 1 – Consequentialism is necessary to evaluate any ethical theory – specifically, existential risk outweighs under any framework because of the inherent value of current and future generations General The Outer Space Treaty’s ban on “appropriation” is a legal black hole – private development is undermining the entire treaty regime Addressing vagueness and regulating private use of space is key to sustaining the OST Contention 1: Debris cascades will render space unusable – private appropriation is exponentially increasing the risks Increased regulation under the OST solves debris – now is key Debris cascades ensure military accidents that spark armed conflict Military accidents in space go nuclear Contention 2: Private appropriation of space violates international law and is driving an arms race – competition will lead to conflict escalation unless states shift to comply with the spirit of the Outer Space Treaty : Strengthening the OST is key to broader international cooperation and international law | 2/7/22 |
