Tournament: any | Round: 1 | Opponent: any | Judge: any The shell is open source disclosed if you want to see the standards and voters sections. The disclosed shell is also an example of formatting that would meet the interp. Contact me if you have any questions, my contact info is on the wiki
*T A Interpretation: If asked for ahead of time, or on the wiki, debates must put their speech doc of the 1nc in accessible formatting in conjunction with the typical formatting. *T B Violation: Their document is difficult for visually impaired people to access. They only disclose a copy of their documents with “cut” cards where they read the parts of evidence they have highlighted. This is inaccessible for two reasons. *T 1 Their formatting is inaccessible for people like me , with ADD or ADHD,like myself, because the parts of evidence that are not being read distract them from the parts being read. *T 2 digital magnification limits the amount of on screen text and requires copious amounts of horizontal and vertical scrolling. It becomes difficult to track position when not reading some text and simultaneously looking for the next highlighted section.
*T 3 screen reader users read documents audibly, but there is no way to read only the tags and highlighted parts due to their formatting. *T C Standard: Accessibility *T The violation clearly lays out why the interpretation is key to accessibility. *T Look at my in round or disclosed documents for an example of accessible formatting. They can’t complain about not knowing how to format their positions because there are examples and I literally have an explanatory how to posted on my wiki.
*T To clarify they should have sent their speech doc both a version of the document with ‘cut’ cards and a version formatted as demonstrated below and on my wiki. By sending both styles of formatting it allows for better access while being able to check for evidence ethics violations if needed.
*note if you're on a Chromebook like me you can use the debate template extension on Chromebook. HOW TO This section is a run down on some quick tips and tricks on how to more easily create accessibly formatted speech docs. (This how to applies to Verbatim)
1 Open the document you wish to make accessible 2 At the bottom of the document create a new "Pocket" using verbatim 3 Copy and paste the first tagline into the new section 4 Open a new blank word document 5 Copy and paste the first card into the blank document
6 Open Advanced Find and Replace (if unsure how to do this for your version of Word look it up) 7 Select the More Options (it should be an arrow on the bottom left of the menu) 8 Under the "Format" dropdown select "Highlight" 9 Towards the top of the menu check the box "Highlight all items found in" 10 Press the "Find All" button 11 Close the dialog box 12 Copy and paste the selected text under the tag you previously pasted (If you need more explicit instructions or a video for steps 6-12 https://www.youtube.com/watch?v=uih6JDLVRnY)

1-Birthday Shell
Tournament: Yale University Invitational 2021 | Round: 3 | Opponent: Strake Jesuit MS | Judge: Waldman, Ben Interpretation: Debaters must say happy birthday to there opponents on there birthday if they have there birthday on there wiki. 1 Birthday depression – when people aren’t acknowledged on their birthday they experience depression because they feel like nobody cares about them. That’s an indepdent voter for psychological violence. Controls the i/l to all other impacts because if someone is sad they wont be in the mood to learn and will perform worse. 2 Encouragement – acknowledging birthdays creates a more positive environment in debate which can spark friendships and interesting conversations like having the same birthday. Friendship is a voter its key to ensuring people stay in the activity and feel welcomed at tournaments especially when debate is online and disconnected. 3 They’ll say infinite regress – A my birthday is on my wiki B its not regressive you only have to say happy birthday on one day I’m not asking you to spec under any other condition. C limited regress is good because it distuinguishes between debaters who actually care about their opponents and prevents debaters from just saying happy birthday for the sake of meeting the shell.

Tournament: Peninsula Invitational | Round: 3 | Opponent: Millard North JS | Judge: Torrez, Andrew Utilitarian ethics are morally repugnant. They exclude disability from moral deliberations and contributes to discourses that marginalize disability. Util justifies eugenic processes to eliminate the presumed suffering of disability. *A Clapton 03 *C . Disability, , is viewed suffering or burden.
This is a reason to drop them – it kills accessibility to disabled people.Reps first – 1 controls the form of argumentation – every arg you make is skewed because you justified them with flawed rhetoric 2 prevents debaters from engaging in your arguments – if you’re arguments justify these things, they may be sensitive to debaters who identify with those groups and prevent them from effectively engaging. 3 reps shape reality because we only understand arguments through how they’re conveyed, just like you won’t vote on an argument you don’t understand.

Tournament: The Newark Invitational 2022 | Round: 1 | Opponent: Village RB | Judge: Jeong, Jonathan Subject formation relies on an autonomous separation of the body and the individual that excludes crips – within civil society, we can never express themselves as autonomous subjects able to move beyond their bodies. From the starting point of Util being pain and pleasure excluding those with Anhedonia, to pragmatism ignoring how those who are excluded from practicing in the political sphere to affect and the sensory moter break down. Ableism must be taken as the starting point when considering ethics. Braswell 11 subjectivity defines the, as autonomous subjects.
The desire to fill the insatiable lack creates experiences of impairment that structures the disability drive. JF- Testimonies V2
Tournament: Peninsula Invitational | Round: 2 | Opponent: Mission San Jose AA | Judge: P Lam, Valorie The notion of fairness in this space is bullshit. I have shifted from Policy to PF to LD. It's all been ableist. The debate is structured through ableism. My freshman year, I couldn't travel out of state, so I could never attend bid tourneys. Policy debate is structured around speed, which, as someone who has dyslexia and a stutter, I was always left in the dust. PF was worse where Parent Judges can decide to screw you over because of your stutter, so you're the only 3-2 that doesn't break. LD is structured around hidden tricks designed to punish those who are dyslexic. But ohh accommodation can solve this problem I hear you saying. Accommodations have been weaponized where people like Cobin read spreading theory and then are told behind their back that they are doing it for the win. Debate as a whole is structured around researching, but how do you do this when the research is inaccessible. Or how am I supposed to have the time to do the research when I already struggle in school. The notion of prep groups requires social skills, which I have trouble with. Or what about my anxiety forcing me to stay up all night? Or what if I phase out during part of the round because of ADHD. I felt isolated during drills at camp because I was the only one not spreading. Not to say my lab mates weren't accommodating, but because I felt different. Or during practice debates at school where no one wants to debate me because that would mean writing a new aff to accommodate the disabled kid. Or me not being able to pull up my files because of my executive function skills. Disability functions as a form of narrative prosthesis. Debaters read Kritiks like this all time and yet don't do shit. They will go for a 1ar Stupid K and then make jokes about the next night in the chat. Or when the Disability is used as a function to profit off. Mollow is the most strategic, so we will read it but let's throw in log con for good measure. Disability functioning off the medical model misses the point. Sure, people have had success despite their Disability, but that misses the point that Disability isn't a static identity but rather a process of viewing people as lesser and based on social context. It's the same reason why dyslexics aren't allowed in the Paralympics. In this case, the social arbiter of context is the judge. This is a space where I have to abandon my identity to get wins. I have to read tricks against people who don't understand them to get wins. The space forces me to replicate the ableism forced onto me, onto others to win. The 1nc will come up here and say that Topicality is essential, or I should have done this as a Facebook post. The notion of change in the debate in the space is tied to you doing well. Those who don't well, like me, are cited off as a joke and not worth even listening to. I can leak all my prep, and no one would even bat an eye because it's not essential to them because of the stigma. The coaches in space are hired by those who were good in high school. When the space isn't accessible, I can never access fairness and education, which makes it a prerequisite to those concepts. When we endorse any form of fairness and education in the debate space, we are leaving others behind. LD debate, in particular, has become a place where the most strategic kritiks are fucking Semicapitalist with a bunch of tricks affirming. The literature is designed in a way where nothing of value matters because the space is filled with inaccessibility, so it's like two ships passing in the night. Even if you believe in Baudrillard, can people seriously say that the literature is being represented in a way other than to confuse people? This also has the side effect of creating an echo chamber where people only read the most extreme positions because it's the most strategic position using ontology to bully others out of the debate space. There are two impacts. First, it makes the space more ableist exclusionary. The traditional model of debate is gain of strength of ballot ignores how certain bodies are structurally positioned to be disadvantaged. I shouldn't have to justify why ableism is terrible, but I will. It's caused me mental strain where I always struggle to know why I even continue in the space anymore. The second is the destruction of debate because the more inaccessible and high theory it becomes, the less likely people for the skills to matter in real-life and leaves a sense of bullshit because they couldn't access the round.

I affirm that the member nations of the World Trade Organization ought to abolish intellectual property protections for medicines. It’s topical – Merriam Webster’s dictionary defines reduce as “to diminish in size, amount, extent, or number,” and 0 protections is less than some protections. And, PICs don’t negate because an exception to a moral statement doesn’t disprove it, just as penguins don’t disprove that birds fly.
Offense

Tournament: Yale University Invitational 2021 | Round: 3 | Opponent: Strake Jesuit MS | Judge: Waldman, Ben The meta ethic is practical reason- 1 Ethics must be derived a priori A Uncertainty – if we base ethics on a postieri knowledge, our experiences are subjective and unverifiable, but principles created with the bases if a priori in the noumenal world are universally the same with all agents. That outweighs because if ethics are subjective that allows people to justify atrocities by saying they don't experience the same B Is/Ought Gap – experience in the physical world only descriptively tells us what is, not what ought to because we won't know the best course of action, only what we can perceive. Thus it's not possible to create an ought statement through descriptive premises which means there must be a premises created in the noumenal a priori world to make a moral theory so we can see if an action is good in a vacuum and in all situations. 2 Agents have a constitutive right to freedom – A Inescapability – to deny agency is self-contradictory because questioning your agency is exercising that same agency. Thus, exercising free agency – justifying judgements and freely taking actions – is constitutive of subjectivity B Principle of Generic Consistency – freedom is constitutive of agency and is necessary good. Denying freedom in general in contradictory since it justifies interference in your ability to take actions and make judgements in the first place – also justifies phenomenal ontological status Gewirth 84 Gewirth, A. (1984). The Ontological Basis of Natural Law: A Critique and an Alternative. The American Journal of Jurisprudence, 29(1), 95–121. doi:10.1093/ajj/29.1.95 JB (brackets for gendered language) Let me briefly sketch the main line of argument that leads to this conclusion. AND on pain of self-contradiction; hence, it is inherently rational.
3 Freedom is not just the absence of interference – a slaveowner who does not interfere in the affairs of their slaves has not made them "freer," because they are still subject to domination, a regime of potential arbitrary intervention. Prefer freedom as nondomination – better corrects noninterfering forms of subjugation through institutional restraints. Pettit '96 Philip Pettit, "Freedom as Antipower," Ethics, Vol. 106, No. 3 (Apr. 1996), pp. 576-604. Pettit is the Laurance S. Rockefeller University Professor of University Center for Human Values at Princeton University and also Distinguished University Professor of Philosophy at the Australian National University. CHSTM Recut JB There are two characteristic marks of the conception of freedom as noninterference. The first AND measure, and to that extent they live in a condition of servitude.
4 Non-domination requires specific interventions by the state to protect the polity from subjugation – laws do not infringe on freedoms but enable them. Only when interrelations are mutually governed by a system of non-arbitrary communal public rules is it possible for citizens to enjoy independence from arbitrary rule. Pettit '05 Philip Pettit, "The Domination Complaint", Nomos, Vol. 46, POLITICAL EXCLUSION AND DOMINATION (2005), pp. 87-117. CHSTM Recut JB This condition already ensures a connection between nondomination and community, for it means that AND sort of community that is bound to have the aspect of an ideal.
Thus, the standard is establishing checks against domination. Prefer additionally – 1 Performativity – debate as an institution is defined not just how we perform as individuals but how we interact as a community, ensuring the community is free of domination by removing subjugating regimes so everyone is equally respected and everyone's voices can be heard is a pre-requisite to being able to debate. 2 Actor-specificity – non-domination is the only notion of freedom that can apply to state actors since individuals always exist in communities and communal governance always involves restrictions 3 Inclusion – analytical philosophy allows for anyone to make responses to it with no carded evidence 1AC – Advocacy Thus the advocacy – Resolved: The member nations of the World Trade Organization ought to reduce intellectual property protections for medicines. Patents, jurisdiction in every country
1AC – Offense 1 Rich countries use IP to block access to medicines from developing countries – vaccine access IS an issue and this perpetuates a global regime of domination. Meredith 4/15 Sam Meredith, 4-15-2021, "Rich countries are refusing to waive the rights on Covid vaccines as global cases hit record levels," CNBC, https://www.cnbc.com/2021/04/22/covid-rich-countries-are-refusing-to-waive-ip-rights-on-vaccines.html JB The landmark proposal, which was jointly submitted by India and South Africa in October AND world leaders, international medical charities, Nobel laureates and human rights organizations.
2 IP for medicine is racist and has historically been used to target black and brown folk.
BP-Weeks 8/21 Maurice Bp-Weeks, 8-21-2020, "Racial Health Disparities Are Fueled by Big Pharma's Patent Monopolies Op-Ed," No Publication, https://www.colorlines.com/articles/racial-health-disparities-are-fueled-big-pharmas-patent-monopolies-op-ed JB The 1NC's innovation DA is just a reification of these dominant power structures – the AND breakthroughs—pharmaceutical companies profit by buying the patents and monopolizing public knowledge.
3 No NC offense and CPs don't solve – Patents are arbitrary and assert ownership over nature and doesn't meet a priori truth. Long 95 (Roderick T., professor of philosophy at Auburn University, editor of the Journal of Ayn Rand Studies, director and president of the Molinari Institute and a Senior Fellow at the Center for a Stateless Society) "The Libertarian Case Against Intellectual Property Rights," Free Nation Foundation, 1995 JL recut Lex VM The moral case against patents is even clearer. A patent is, in effect AND the idea on his own, will be forbidden to market his invention.

SO- Lay Kant with Util advantage
Tournament: Grapevine Classic | Round: 4 | Opponent: Interlake DB | Judge: Tarikere, Navya I Affirm the resolution resolved: The member nations of the World Trade Organization ought to reduce intellectual property protections for medicines Framework I value morality and the criterion is the categorical imperative. Moral law must be universal—our judgements can’t only apply to ourselves any more than 2+2=4 can be true only for me – any non-universalizable norm justifies someone’s ability to impede on your ends. Korsgaard ’83 when a rational being undertakes an action, they suppose its pursuit to be justified there must be something that is unconditionally good and can serve as a sufficient condition of goodness it cannot be an inclination the unconditionally valuable thing must be "humanity" regarding your existence as a rational being as an end in itself is a "subjective principle of human action." we must regard ourselves as capable of value we must regard others also as ends in themselves
Thus the criterion is consistency with the categorical imperative. Prefer additionally – 1 Kantian theory has the best tools for fighting oppression through combatting ethical egoism and abstraction Farr 02 The Formula of Universal Law joins that we act only on maxims that are open to others The individual is not allowed to exclude others abstraction require a demand for intersubjectivity avoid ethical egoism in maxims for actions To avoid egoism one must abstract from subjective maxims that contravenes racist ideology based on the use of persons of different race as a means to an end 2 An understanding of Kantianism is key to understanding the law in the real world because states abide by inviolable side-constraints in their constitutions Otteson 09 agency set limits on the state the only “coercive laws” to which individuals may rationally allow are those that require respect for agency human progress is possible only under a state that defends individual freedom. happiness is a great but ancillary benefit. the reason we leave the state of nature is to secure maximum freedom compatible with the same freedom of others. 1AC – Offense – 4:00 1 IP rights prevent certain people from receiving the fruits of their mental labor. Lindsey and Teles 17 patents violate entitlement to mental labor inventors who come second in race have no right to their ideas infringement lawsuits rarely intentional infringers developed products on their own weren’t aware of patent patent laws look like intellectual monopoly 2 IP Rights hand partial control of others property to IP Creators. Kinsella 13 IP rights give partial control over property of everyone because they can prohibit performing actions with their property Author X can prohibit party Y, from inscribing pattern of words on Y’s own pages own ink IP law takes property of material owners 3 Justifying ownership based on creation is unjust. Kinsella 13 distinction between creation and discovery not clear No one creates matter they manipulate it engineer invents mousetrap rearranged existing parts mousetrap follows laws of nature Einstein discovery of E = mc2 allows them to manipulate matter Yet one is rewarded unfair to leave theoretical researchers unrewarded 1AC – Advocacy Thus, the advocacy – Resolved: The member nations of the World Trade Organization ought to reduce intellectual property protections for medicines. The neg should also have an advocacy text else it’s irresolvable and impossible to know what they defend. The plan solves – reducing IP for medicine is consistent with democratic ideals, builds revolutionary movement against neoliberalism, and provides reparations to Global South Hanna, 9-21-2020, " - Link turns cap Ks and setcol, read unhighlighted part - RandD – research and development - Specs patents - As countries grapple with COVID the injustices of current IP and RandD are apparent we move away from current system that prioritizes corporate profits to one that values public health IP systems are critically important Rather than supporting innovation ownership of creations of the mind has been capitalized on profits and increase power of large corporations IP systems could be harnessed for equitable, democratic future Extending principles of democratic ownership is key to this transformation increasing public RandD to 2 boost innovation and create environmental reliance this strategy need to grow public stake in IP involved in shaping the distribution of innovations we need to explore ways to bring about universal access to medicines from big pharma US and UK acknowledge wrought on much of the rest of the world A reparative approach must mak prices affordable By applying democratic ownership we can turn these systems sustainable 1AC – Adv The Advantage is Democracy. Global democracy is collapsing now Freedom House 3/3 Authoritarian actors grew bolder report found countries designated Not Free has reached its highest level since the deterioration of democracy in 06 India’s status changed from Free to Partly Free changes formed part of a broader shift in the international balance between democracy and authoritarianism Belarus and Hong Kong prodemocracy protests met with brutal crackdowns by governments Azerbaijani Armenia China Authoritarian powers are advancing interests around the world, while democracies have been divided For freedom to prevail the U S and partners must band together to strengthen democracy at home and abroad. India is in a democracy crisis now which has caused the second wave. Singh 7/5 India’s humanitarian tragedy is linked to democratic erosion India from free to partially free the country an “electoral autocracy.” India’s coronavirus crisis and democratic backsliding linked decline of free speech BJP undermined civil liberties This affected journalists Police raided offices of media outlets Some gunned down in their homes attacks on freedom harm democracies’ functioning That leaves governments making decisions in isolation Under colonial rule famines were numerous the difference has been journalists reporting early signs of famine in uncensored media and pushed government to act. But India prevent journalists from reporting covid-19 information the government filed charges against journalists reporting mismanagement of the coronavirus crisis migrant crisis shortage of oxygen this prevented government from accessing accurate information about pandemic These are dangerous because democratic institutions are weak Muzzling free speech has been deadly during the pandemic the scale of covid crisis continues across India remains unknown A free press could provide critical early information about second wave and pressure government to take action
